1855: more evidence that an appeal to Bernard Michel is effective

France2 declares 1855 an 'arnaque'

This message from AB is further evidence that contacting Bernard Michel of the BIEV is an effective way of squeezing refunds out of the 'fraudulent' 1855 group: 

'Hi Jim,

I wanted to let you know that, on your recommendation, I wrote to Bernard Michel. He answered immediately, suggesting different issues, among them that 1855 could reimburse the wines, and copied 1855 at the same time.

They then answered the following day, saying that I would be reimbursed, and I got my money back (without interests of course, but it was more than 5000 €…). They say that they can ship Margaux 07, and I am waiting this.

This puts an end to this sad saga. It also clearly shows that they had not bought the wines “en primeur” (even the wines they were supposed to “hold” in their cellars on my behalf) and that they have cheated their clients on a very big scale. I wonder how they could pretend to organise a shipping “in the next few weeks” as they wrote repeatedly, as they had to get the wines at market prices far superior to the “primeur” prices…

Obviously, I will never – never order again anything at 1855.

Interesting post here yesterday on La Passion du Vin on the Cave Privée thread by Daniel Popp, who published an email sent to Fabien Hyon in his role as person in charge of Cave Privée by Bernard Michel of the Brigade Interrégionale d'Enquête Vins et Spiritueux (BIEV). Bernard Michel mentions an investigation and a meeting at the offices of Cave Privée with Fabien Hyon – 'Faisant suite à notre enquête et à notre réunion au siège de Cave Privée à Paris':

Daniel Popp et de proposer en parallèle le remboursement de ces vins comme le prévoit le code de la consommation à l'article L. 121-20-3 qui précise à l'alinéa 2 que "en cas de défaut d'exécution du contrat (de vente à distance) par un fournisseur résultant de l'indisponibilité du bien ou du service commandé, le consommateur doit être informé de cette indisponibilité et doit, le cas échéant, pouvoir être remboursé sans délai et au plus tard dans les trente jours du paiement des sommes qu'il a versées. Au-delà de ce terme, ces sommes sont productives d'intérêts au taux légal".

Cela permettra au plaignant de choisir l'option qui lui convient.

Good to see Bernard Michel of the BIEV taking a close interest in Daniel Popp's undelivered wine. If M. Michel decides to take an interest in all customers' outstanding orders for the 1855 group – 1855, Chateauonline and Cave Privée – Fabien Hyon and Emeric Sauty de Chalon had better provide M. Michel with a desk as he will be spending a lot of time with them!

1855's share price continues to look sickly with the price oscillating between 0.03€ and 0.04€. Although the shares finished at 0.04€, most of the transactions by value were at 0.03€. See table:
