Charles Ponzi – the inspiration for 1855?

The saga of this 1855 arnarque (fraud) continues without interruption and increasingly includes the associated companies: Cave Privée and ChâteauOnline.

There is also a recent post on this thread by a client of Cave Privée who has ordered some of Guy Bossard's fine Muscadet. The order has been placed by Cave Privée but has not been dispatched because the wine has not been paid for.

Only this week Decanter magazine asked me to write a response to a client of ChâteauOnline. The client, who is based in the UK, had ordered some 2008 Bordeaux en primeur. Now ChâteauOnline are refusing to deliver his 2008 en primeurs to the UK and he is finding it impossible to contact them.

The first clear lesson here is not to buy from 1855, Cave Privée or ChateauOnline.
The second lesson is that if your wine does not turn up in reasonable time to take legal action in France or, if you have paid by credit card, to get a refund from your credit card company.

1855: same problems with Cave Privée

The growing 145-page thread on La Passion du Vin clearly shows that the long-term problems customers face with 1855 in getting their wines are now being experienced by people who order through Cave Privée. Cave Privée is now owned by 1855 and is managed by that genius – Fabien Hyon.
Some customers do get their wine but it is frequently months late and meanwhile they get fobbed off with the same sort of lame excuses and unfulfilled promises that clients of 1855 experience. My guess is that some of the delays are due to producers either not wishing to deal with the crooks that run 1855 and Cave Privée or not being paid and therefore not supplying Fabien Hyon and Emeric Sauty de Chalon with wine.
The advice given by a number of La Passion du Vin posters not to deal with Cave Privée is surely wise and eminently sensible.

1855 Assemblée Générale (AG): how long will Jean-Pierre Meyers continue to support these crooks?
The spirit of Charles Ponzi will be at 1855's Assemblée Générale today
1855 will hold its AGM for its shareholders today at the Hotel Ibis Ledru Rollin close to the Gare du Lyon in Paris – starting time 10.30h.
It would be good to think that they will take this opportunity to demand that Emeric Sauty de Chalon and Fabien Hyon start running 1855 and its associated companies – Cavée Privée and Châteauonline – as proper businesses and cease to defraud their customers by failing to supply the wines, especially Bordeaux en primeur, ordered. That they will also ask how many hundreds of court cases 1855 is currently facing.
Will they ask about the latest mention of 1855 in La Revue du Vin de France?
They might also ask these internet geniuses why share information for investors isn't updated. They manage to change to the date but not the share price nor the company valuation nor the number of shares. Come Fabien Hyon get yourself organised!

I fancy the chances of the investors asking pressing questions are as probably as slim as the Bordelais, apart from a few honorable exceptions, having the courage to condemn 1855 and warn people not to deal with them.
No my guess is that the most pressing concern for Emeric Sauty de Chalon, Fabien Hyon and the investors is how much longer will Jean-Pierre Meyers be prepared to support this scam. When will he decide that the damage his association with 1855 does to his reputation as one of France's most prominent businessmen is too great? What I wonder do Jean-Pierre Meyers' fellow directors at L'Oréal and Nestlé make of his support for 1855?

1855: record Ponzi sentences – an appropriate tariff for Emeric Sauty de Chalon and Fabien Hyon?

Last week Allen Stanford was sentenced to 110 years in jail for running a Ponzi scheme:

Substantial although Stanford's 110 year sentence is, it is easily eclipsed by 150 years given to Ponzi king – Bernard Madoff:

The huge sentences handed down to Madoff and Stanford raises some intriguing questions in respect to 1855 and, in particular, to Emeric Sauty de Chalon and Fabien Hyon. If these two scamsters were ever tried and convicted of fraud what would be an appropriate sentence – what tariff ought to be applied?
There are naturally a number of caveats here.
Neither Emeric Sauty de Chalon nor Fabien Hyon has yet been charged with any crime. Indeed they appear to continue to enjoy a high level of protection allowing them to continue to fleece a significant proportion of their customers with apparent impunity. As Emeric de Sauty de Chalon said in a video here the internet is 'une utile magique' (I assume he meant a wonderful invention for trousering your customers' money).
Clearly some people get their wines, even those who order Bordeaux en primeur. However, the blizzard of court cases against 1855 graphically demonstrates, a significant number do not and are systematically fobbed off with unfulfilled promises assuming that they are able to contact 1855 – a big assumption!
It is also clear that, although the frauds perpetrated by 1855 have been going on for some considerable time, they are nowhere near the magnitude of those committed by Stanford and Madoff.
So what would be, if the circumstances arose, an appropriate punishment for Emeric Sauty de Chalon and Fabien Hyon?
Shares in 1855 today traded between 0.03€ and 0.05€. Trading closed at 0.04€ and most of today's transactions were at 0.04€.

1855: has Hollande's election spooked the shares?

It may be coincidental but the trade price for shares in 1855 has been lower since François Hollande was elected President of France. Previously trading had been largely between 0.06 and 0.07€ a share. Now it oscillates between 0.05 and 0.06€. Volumes traded are also noticeably down but this may be in part due to the large number of French public holidays in May.
Yesterday the share closed down at 0.05 – down 16.67% on the year ie one centime. They opened up at 0.06 but have since slid back to 0.05 admittedly on thin trading. Already a junk bond will the price drop still lower?

Has Nicolas Sarkozy's defeat removed some of the high level protection that 1855 appeared to enjoy? There are suggestions that Sarkozy may have received illegal funding for his 2007 presidential campaign from the Bettencourts. Might in return 1855 have been treated leniently, despite its truly appalling trading record, as Jean-Pierre Meyer (the husband of Françoise Bettancourt) is a major shareholder in the company?
Also it is not clear whether 1855 has now become a full-time member of La FEVAD. The ponzi scheme/scam was admitted as a provisional member of Le FEVAD on 31st January 2011. Certainly 1855 is listed as a member on the FEVAD site with no indication that they are on probation. If 1855 is now a full member I understand that La FEVAD will now become La Fédération des Escroqueries Virtuels et Arnaques Diverses and its code of conduct will be declared an official blague.

It was good to meet Daniel Ornon, sales director at Château Smith-Haut-Lafitte, at a busy Bordeaux Grands Crus Classés tasting in Somerset House, London today. Ornon is one of the few people at the top of the Bordeaux wine pyramid prepared to speak out against the 1855 scam. He has also been keen to persuade a number of French journalists to write about the 1855 scam
Should François Hollande win the French presidential election on Sunday will the apparent protection that 1855 appears to enjoy be reduced, given that the Bettancourts are said to have helped to bankroll Sarkozy's 2007 presidential election? Jean-Pierre Meyers, husband of Françoise Bettancourt-Meyers, is a leading shareholder in 1855.

Fabien Hyon (1855 + ChateauOnline) promises but doesn't deliver

I was contacted today by RV, a Bordeaux en primeur client of ChateauOnline. Over the years RV bought en primeurs regularly from ChateauOnline and, although there were some problems over bottles being broken in transit, the wine ordered did arrive.
RV's experience to date with the 2008s, now that ChateauOnline is part of 1855, has been less than reassuring. Some of RV's substantial order of 2008s, including Mouton-Rothschild and Lafite, was delivered back in August 2011. There are still 14 cases outstanding, amongst them some First Growths.
Back in February Fabien Hyon promised by email that the remaining wines would be delivered rapidly – since then not a squeak from Hyon and no wine either. (See emails below.)

did some research to find the MD and found it was Fabien Hyon so emailed him
(21/2/12) about my missing wines (24 Calon Ségur, 36 Carruades de Lafite, 24 Les Forts de Latour, 24 Haut Brion, 24 Mission Haut Brion, 24 Clarence Haut Brion
and 36 Latour!) and he did at least reply see below....but since that message
nothing and he no longer replies to any of my messages...it's outrageous. Do
you know of any lawyer in Paris who has managed to receive financial
compensation for the present value of their wines and all the stress that this
is causing?

After thin trading today on the French Bourse shares in 1855 closed down at 0.06 cents down on last week's close of 0.07. At the beginning of 2012 the shares opened at 0.06 and then gradually rose until about a month go they briefly hit 0.10. Since then it has been back downhill confirming their junk bond status.

You may be surprised to hear from me – after all I moved onto a new entrepreneurial sector in January 1949.
However, I have been so impressed by the way that you and Emeric Sauty de Chalon have managed 1855 maintaining with considerable élan the fundamental principles of a Charles Ponzi business. The fact that you and Emeric have managed to both keep the business afloat paying off creditors and customers at the last moment reflects great credit on you both, despite an increasing number of legal cases. I'm equally impressed that you have managed to keep Jean-Pierre Meyers on side, willing to splash the cash to keep 1855.com afloat. You, two, are indeed my worthy successors.
Fabien, on a personal note, I also feel impelled to contact you because of the remarkable similarities in our physical appearance. When I saw your photo here I did a double take before realising that this is you and not me as a younger man!

The 1855 scandal: an open letter and appeal to journalists and writers attending the 2011 Bordeaux en primeurs’ tastings

Over the next fortnight the wine world’s
attention will be on Bordeaux with the 2011 en
primeurs tastings. Many of you will be present there tasting and assessing
the new vintage.

This coming fortnight is a great
opportunity to turn the spotlight on the continuing scandal of 1855 (1855.com)
and its failure to deliver a significant proportion of the Bordeaux en primeurs
ordered by its clients. The failure to deliver has now spread to ChâteauOnline
bought by 1855 in March 2011 with customers now find that their 2008 en
primeurs have not been delivered.
Although 1855 is based in France, it has
disappointed and long suffering customers throughout Europe, waiting for en primeurs ordered and paid for stretching
back to 2002.
Between November 2010 and March 2011 I kept
a count of the Bordeaux en primeurs that 1855’s customers reported had not been
delivered. The list of wines reached a staggering 500 cases outstanding with a
value of just under 300,000€. As 1855 has a policy of delivering outstanding
wines to those who shout loudest or who start legal action, and usually in
dribs and drabs, it was not practical to continue to record the en primeurs not
delivered.
1855 has claimed that it has placed firm
orders for all 2009 en primeurs ordered through them. This may possibly be the
case but on previous experience it is all too likely that there will be
problems with 2009 en primeurs ordered through 1855. On the La Passion du Vin forum there is a
thread called ‘1855 retard des primeurs’ that now runs to an astonishing 122
pages and is full of stories of wines ordered but not delivered, promises made
by 1855 and repeatedly broken as well as advice on the legal options available.
Many customers have concluded that the only
way to get 1855 to deliver their wines or obtain compensation is to go to
court. Only last week a customer was offered by 1855’s lawyers before a
Parisian court double the purchase price in compensation for his undelivered en primeurs from vintages 2005 and 2008.
Surely a clear indication that 1855 failed to buy the wines this client
ordered.
It would be great if you would warn your
readers that buying 2011 en primeurs through 1855 and their associated
companies – Cave Privée and ChâteauOnline – is all too likely to lead to
disappointment and non-delivery of the wines ordered.
Much better to order en primeurs from more
reliable and reputable companies.

During your stay in Bordeaux it would also
be great if you would express your disappointment at the woeful and supine
response by the Union des Grands and the Conseil des Grands Crus Classés to the long
running scandal of 1855.
With a few honourable exceptions, such as
Château Smith-Haut-Laffitte, the leading estates of Bordeaux have failed to
warn purchasers of their wines of the well-documented dangers of buying
Bordeaux en primeurs through 1855. Their response to this scandal has been
shameful and craven, especially as they are certainly in a position to issue a
strongly worded warning in relation to 1855. Instead the Union and the
Conseil have sat on their hands and said nothing.
Please ask the Union and the Conseil when
they are going to speak up or are they content to see people who buy their
wines fleeced?
Anything you can do to highlight and warn
potential buyers dealing with 1855 will be much appreciated. You have the power
to make a difference!

Double your money with 1855!!
Château Lynch-Bages: a case of 2005 ordered from 1855
Double your money with 1855! Yes it sounds incredible but with the right legal advice it can happen as RD, an 1855 client, discovered yesterday at the Tribunal d'Instance. 2376€ has grown to 5649.40€, an increase of nearly 138%! This is just above the current value of the wines that 1855 has failed to deliver.
Like all too many of 1855's clients, RH ordered and paid for five cases of Bordeaux en primeur: three cases of 2005 – Rauzan-Ségla, Lynch-Bages and Kirwan – and then a case of 2008 Giscours, which he ordered from Châteauonline. RH paid 2376€. This was part of a much larger order that 1855 delivered in dribs and drabs and involved earlier court action. When 1855 failed to deliver these remaining wines RD decided to take the company to court again. He employed the services of Gwendoline Cattier of Deprez Guignot Associés, who already has a track record of success in cases against 1855.
The hearing at the Tribunal d'Instance in Paris was yesterday. A few hours before the hearing 1855's lawyers offered 5649.40€ as settlement of the claim. This includes vat and transport, which RH had not paid.
RD accepted the offer on the advice of Cattier and the following was agreed at court yesterday:
It was agreed that RD would receive in
compensation double what he had paid for the 2005 and 2008 primeurs. Part of
this agreed sum should be paid before the end of April
1855 would deliver RD’s 2009 primeurs
before 31st July 2012
At least some of RD’s legal fees would be
paid by 1855
There should be a new court hearing after
31st July to see if the RD’s 2009 primeurs had been delivered.
In addition to the 2005 and 2008 en primeur, RD also ordered some 2009s from 1855 and Châteauonline. 1855's lawyers have argued that these might still turn up, so for the moment they are not included as part of the compensation package agreed. It is, however, clear for the offer by 1855's lawyers that at least part of the 2008 en primeurs ordered by customers have not been paid for by 1855, whether or not they placed orders.
It remains to be seen whether this will be the same for the 2009 en primeurs ordered through the 1855 group. It is also clear from this example that it is worth taking 1855 to court provided you employ a lawyer who is conversant with this shower's modus operandi (or non-operandi!). It is also clear that, long-term, these sorts of settlement are a suicidal business plan unless Emeric Sauty de Chalon and Fabien Hyon can persuade Jean-Pierre Meyers to continue to empty his pockets to keep this scam afloat.

My post this week on Les 5 du Vin is a return to 1855. I continue to receive regular complaints about 1855's failure to deliver Bordeaux en primeurs to their clients. This problem has now spread to chateauonline acquired by 1855 last year. The post includes a kind offer of assistance from a client who is taking chateauonline to court.

Thierry Maincent was a director and one of the directeur général délégués until he resigned his posts for personal reasons on 30th September 2010. Mark Adams, an extremely frustrated client of 1855, covers in his column in Property Week (160,000 unique pages views per month) his recent trip to a Paris court to try to prise his wine out of 1855.
'If only I had purchased the case of Mouton Rothschild 2008 which brought me to Paris on 17 November from Corney & Barrow or Justerini & Brooks. A message from GH, a similarly frustrated client of 1855, now considering his legal options:
'I appreciate your comments and your efforts to bring to the light the business practices of 1855.
Their behaviour is a huge scandal; many questions arise why the French authorities didn't close down this company already a long time ago.
I am myself a victim of this company concerning the 2008 Bordeaux subscription and missing delivery of those wines so far as many other wine lovers are; not thinking about the problems of the 2009 Bordeaux delivery that will probably come to the surface soon...
Reading all the blogs now I honestly have a lot of doubts that I will ever see those wines especially with regards to the fact that I took advantage of the spring 2009 economic crisis with a bit depressed prices for the big names like Lafite Rothschild and Latour, wines that I am waiting for...
I had many phone calls and mail conversation with those guys from 1855 and just got to know that delivery is gonna be delayed but will certainly happen.
